if you helped make the pie maybe but not in this case. This is not some sort of capitalism for merlin sake, this is her property. Thats what Copyrights mean. She owns the idea, and taking it is plain theft. Nothing else. Very simple. You want to enjoy the pie? sure eat, enjoy. but its JKR's pie and you cant sell it. sorry if I took the pie analogy too far. I'm hungry.

I've started reading it. Mr Vander Ark said that he tries to dissaude people from creating Harry Potter encyclopedias, because he knew Jo was making one? He said that ages ago, too. Merlin, does he think no one is going to notice this?

Must say that I think that a fansite like Mugglenet deserves at least to get a personal by the author written request not to publish a book and not just by a lawyer who did not even consult the author about the matter. Wether I agree with opinions held here is beyond the case, but Mugglenet is one of the most important fansites among fandom and you don't treat that so respectless

I just spent over an hour reading up on the first day, and I can now say that with the evidence behind me, RDR is completely ridiculous and JKR should definitely win. To me, it comes down to the fact that JKR wrote the HP books, and she doesn't want a crappy encyclopedia published on her work. She's writing her own encyclopedia which is plainly far more useful; I mean, did you SEE the lexicon entry on "ogre"? That is in no way useful. The stupid freaking lexicon better not be published. If it is, there is no way I'm buying it. And I'll do whatever I can to make sure that no one else buys it, either.

hey mugglenet was gonna write a book.... Is it true that you had your lawyers stop the 2 publication of a book by the staff of Mugglenet this last year? 3 A. I know that my -- I know that my lawyers asked them to, I 4 think, not to proceed with plans to produce a book very like 5 the Lexicon. mugglenet rockss. :D

Having read a lot of JKR's POV, I think she has a strong case. Other guides to the HP books are very, very careful not to do several of the things that Vander Ark does, like use a substantial amount of direct quotations, fail to identify quotations, and simply reiterate plot and text. Seeing examples of how much text was lifted from the original series, it floors me that the publisher and the author of the Lexicon did not see this coming. Well, Vander Ark obviously did by making sure there was a clause in his contract that would make RDR take the fall. To all the people making the comments about the lawsuit being ridiculous, or about JKR being overprotective or greedy, I have to say this: JKR has been extremely gracious to her fans. She has never tried to stop publication of fan fiction, no matter how risque or far from canon. She has been respectful of fan sites, generous and active on behalf of charities, and seems never to have forgotten her humble beginnings. Even if she loses this case, I have the utmost respect for her. If nothing else, she has given us a great gift that continues, almost a year after the series ended, to bring us all to this Web site. She made all of this money because, frankly, we gave it to her so we could read the books and see the movies and play the videogames. How can we begrudge her the money when it came from us? And how can we not understand, even if we don't agree, her desire to protect her creation and her fans from what she sees as an illegal attempt to make a quick buck off of her greater talent? It's just a shame.

It's VERY lengthy! I'm reading it through. I'm surprised though, I would never have thought that the genreal public would be allowed to see this information. I thought it would have been court classified. Meh. Interesting though... Jo's very good at answering all these questions fired at her. Vander Ark should never have announced of his desire to publish a HP Encyclopedia. It was always well in Jo's rights. :]

the verdict was not given yet. The trial is far from over guys,its not going to be this simple or this easy. nothing that matters ever is simple and easy. and this really matters. Reading this transcripts will help you learn more about the cases of each side and anyone who want to make educated opinions on this matter, on this site should read them. Read, understand and then form whatever opinion you want otherwise you are just waisting time arguing with other people about this case.

I've read all this drivel and I honestly think that Jo needs to chill out. I guess I don't really understand her getting all worked up over "copyright" infringement just because this dude is wanting to print up a book full of information he's already giving away for nothing online. Who in the world would buy his book anyway ... to what end? The info is FREE .. why buy the cow? Now, if I were her and wanted to sue someone for stealing her work, I'd probably go about trying to shut down some of these websites that are using her material to make names for themselves. I've never even visited the HP Lexicon, but I'm always looking in on TLC, Mugglenet, Verisaterum, etc. etc. ... Their combined righteous outrage on Jo's behalf just looks like a desperate attempt to keep her lawyers off their own backs. This entire trial is just a tempest in a teapot and so completely tiresome. It's ruining her image, or at least the image she ought to be cultivating for herself, ala an "above it all" mentality. After her ridiculous and unnecessary "outing" of Dumbledore, now she's in the courts suing a FAN ... seems like she can't stand her name and Harry not being a news item. So pathetic. So desperate. So last year. Sorry, Jo, but you need to start acting your age (and mine).

ok since it suddenly seems like the majorty here agrees with RDR, I feel the need to comment here and say that I've read the transcripts and I agree with Jo. The Lexicon seems to be a lame excuse for a refernece guide, it lacks in orginal work and doesn't add enough if at all. As a hardcore fan, I feel insulted by RDR and SVA assumptions that I can't fnd the information they want to publish all by myself. This book is ment for the obssesive HP fan. It is not a study of some sort so it cant be used for anything else but for me to look things up more easily. However, having read the books as many times as I have(which is the giant number most MN users have), I can probably find all these obvious details by my own inside the books much faster then I can find them even in an alphbetical guide. I dont think that makes me special, I think most of the people who visit this site as much as I do can. The lexicon is useless for me. And other then that it is an attempt to steal a big part of my life from a wonderful woman.

I find it ironic that JK talks about how she wants to keep the authenticity of her books by pursuing a law suit against this glossary, but then she agrees to have a theme park made. Hardly keeping the authenticity of the Harry Potter books....I realise there are other reasons, like her own encyclopedia for charity, but that particular reason is a bit ironic.

I'm really surprised how many people want this book published when it contains incorrect information and blatant copying and pasting of JKR's work. Had this been any other author-- any copying and pasting would be strictly forbidden-- but so many people are wrapped up in this case thinking Jo wants money from her encylopedia, which she doesn't by the way. It's just really insane how misinformed people are about this case. If you read other forums, you see people saying "oh, she's so greedy, she just wants more money" when it's completely from the truth. These books were her creation, this world was her creation and she put her whole life into it.. and for someone else to literally "copy and paste" her work and put it into their own book hoping to make a quick buck is pretty lame. And so are all the people who are blind to what this is going to do to the copyright world.

As a writer myself, I have to disagree with all of the comments telling Jo to 'chill out'. This is her creation; her BABY. What he did was wrong. He was not analyzing or commenting on the series like other books have don, but simply publishing a version of his website which only used the author's words. THAT is both infringement and plagiarism which are illegal activities. He knew full and well what he was doing, as proven by the transcripts. While books such as What Will Happen in Book 7? are acceptable, what this individual was hoping to do was not. He previously recognized that it would be a bad idea, but when turned down as a co-creator in JK's books, he turned around and tried to do it anyway? Her work is not public domain; it is not free for anybody to do with as they wish. We have a right to protect our works, and that is all that she is doing. While I agree that it would be ridiculous to buy the book anyhow, considering that JK is creating her own, there would certainly be those who would indulge.

Wow. Cool to read, but I don't have 8 hours to read all that. It is kind of interesting, though. Jo needs to win because the Lexicon (that is the HP fansite harrypotterlexicon, isn't it) can't use her characters and her world without permission from her. Especially to make profit and cash in on Harry Potter. I would wait and buy J.K.'s encyclopedia.

I keep checking back here for the verdict. Vhere eez it? Hopefully that judge will decide soon enough. I really can't see him going for SVA and RDR. What scumbags. Oh I also had no idea that SVA was 49!! I always pictured this poor, sad, 20 year old kid! It's kind of hard to wrap my mind around all this now. As much as I absolutely love HP, it sort of seems like someone his age should have moved onto a real career by now... or not. *shrug* I just always pictured him Emerson age.
