'Wyrd Sisters' to compensate WB
Last November we reported that Winnipeg musical group, Wyrd Sisters, sued Warner Bros. and attempted to have GOF banned from distribution across Canada because they believed a band with a similar name, The Weird Sisters, featured in the movie; the name of the band was never actually mentioned in the flick. They lost their case and have now been ordered to reimburse WB's $140k legal fees.

So what was their complaint? I mean, having the same name as something in Harry Potter would've just brought them more fame, but no, they wanted their fame faster. Stop bring legal issues against Harry Potter just to get your 15 minutes! I'm really glad they didn't succeed in banning it from canada, because i'm from there! I'm willing to be that it was them who coppied the name in the first place, it was JKR who came up with it anyways, not the WB. I don't think their name was even mentioned in the movie.

What I thought was interesting is that in the Deluxe 2 disk DVD version, the band is introduced as the "Weird Sisters". Maybe WB took it out of the final product BECAUSE of this case. I don't know if it not being in the final movie is why they are getting compensation but I'm not saying they don't desirve it either ;)

That is so stupid! There name was not even mentioned in the movie, so therefore they should realize they would loose there case. And, anyone who sues Harry Potter is bound to loose.

THAT'S RIGHT!! man, that band really pissed me off. firstly, i don't know how the band pronounces it's name, but i know the word "wyrd" [as used in beowolf] is pronounced "v-ear-d" [rhymes with beard], and means fate. so that word really has nothing to do with "weird", other than the fact it could be mistakenly pronounced the same way. serves them right. those frikken money-scaming morons.
Okay, now that's just dumb for two reasons: 1) They didn't even mention the name in the movie, so it's pretty much pointless to sue WB for nothing, and 2) JKR put the name in the GOF book about 6 years ago, so why are they suing NOW?

I have actually seen the Wyrd Sisters at a concert before, and I quite liked them. But after hearing this redonkulus charade of theirs, I lost all respect for them. Money makes you greedy, people. Actually, to eatpickledhumans, I think "Weird Sisters" is a play on "Wyrd Sisters" which was a term used in Shakespeare's Macbeth. Bands often change the spelling of phrases or words, which is why I think JKR changed the spelling. But this is really besides the point, since the Wyrd Sisters from Canada had no right to sue in the first place.
I would have taken the 50,000 dollars WB offered them to settle and be done with it. So they could have been up 50K but now they're down 140K

Wyrd Sisters? It's not even SPELLED the same! And it's not like the 'Weird Sisters' is a REAL band, it's just in a storybook!!! And they tried to SUE WARNER BROTHERS?! WHAT?! Warner Bros. didn't DO anything! It's kind of like suing one soda company because their soda TASTES like ANOTHER soda! (I would use examples, but I don't know whether or not Coke came before Pepsi) Anyways, didn't the article say they're being fined or something? HOORAY!
Actually, JKR didn't come up with the name either. The idea of "wyrd" dates back to 1100 AD in written form (from Beowulf), is mentioned heavily in the writings of Shakespeare, and possibly dates back even earlier. In Beowulf and many Shakespeare plays, there were often three witches who told the future (like the Fates in Greek Mythology). They were often referred to as the "Wyrd Sisters." Wyrd was a word for someone who had odd gifts of prophecy. The idea that a band would sue over a name like that is just dumb. It's like calling your band "Eggs" and getting mad if someone used it. On the other hand, you can start a band called the "Eggs," trademark the name, and then legally own it. If the Canadian group had trademarked it, they most likely would have won suit against JK, though not WB (since they didn't mention the name in the movie).

I find it funny that the Canadian female folk band would sue Warner Brothers and the actors/musicians that performed in the movie, but not anyone else who ever used Wyrd/Wierd sisters. Terry Pratchett (1988 book Wyrd Sisters), Three Wyrd Sisters (American/Celtic band who publically stated they had no problem with the WB use of Wierd/Wyrd Sisters) and Marvel Comics Uk (Wyrd Sisters characters that they have used), among others have used a form of the name, likely in an honorary nod to Shakespeare and possibly other earlier mythological/writings about "Wyrd Sisters". I have searched and searched but have found no Canadian or American registration for trademark by the Canadian Wyrd Sisters (CWS from here on in my rant). Warner Brothers did its job before using the name by finding the CWS, and offering them ANYTHING because they were going to use the same name was a kind gesture. The CWS should have gotten a trademark a long time ago. When WB decided to not use the name, most people would have said OK fine & stopped the lawsuit, and ran and gotten all the copyrights needed, should it ever come up again. The part about the lawsuit that bothered me the most was filing against Jarvis Cocker, Radioheads Jonny Greenwood and Phil Selway, and the other musicians. Asking for 20% of future earnings? It is not likely that the musicans who played the roles will go on tour together as the "Wyrd Sisters from Harry Potter" since they are all well established in thier own right. The CWS are under the impression that if they are to go on tour, say to Australia or New zealand for example that the only ones showing up at thier shows will be Harry Potter fans, who will be dissapointed and want their money back. Now they(CWS) must think that all Harry Potter fans are sheep just flocking to a name & not at all intelligent. They loyal book fans know it is Wierd Sisters not "Wyrd". The fans of the movies alone did not have a name of the band. continued...

...The fans of both venues have done the research, come to wonderful sites like Mugglenet for the news, and would not get fooled into going to a CWS show. The CWS thinks we will mix up an eight member extremly hairy all male "rock" band with three female folkies? What the CWS has done is made them known to many people who will still not see them live, or buy a CD of them. Bad publicity is better than no publicity. Anyway, they lost and have to pay court costs and most likely the WB lawyers, at least many people know who they are now. You have to wonder if the outcome would have been the same if the name of the band in the book was Arrowsmith or The Beetles. Since similar cases have gone traditionally in the original artists favor, one wonders. As much as I love Harry Potter, I dislike trampling the little guy even more.

doesn't that band know that the movie is based on a book that came out in 2000?? I agree that JKR used the band in the book and why didn't they say anything before? If anything they copied the name from the book!! Thank god they didn't win their lawsuit!! :)
That's too funny. I remember reading the original story. What a sad little band of wanna-be's. They wanted to sue WB for stealing a band name that THEY stole from Shakespeare first. I hope they are ruined. I know they lost a lot of fans when they tried to sue WB, because they made it clear that they were all about money, despite the folksy, non-materialistic image they tried to portray with their music.
